Terms of Service

By accessing or using getVibeMotion ("the Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. If you do not agree to all of these Terms, you must not use the Service.

These Terms constitute a legally binding agreement between you and getVibeMotion. You represent that you are at least 18 years old or the age of legal majority in your jurisdiction.

getVibeMotion is an AI-powered video and animation generation platform. We provide tools that allow you to create, manage, and share AI-generated videos and manga using various third-party AI models.

The Service acts solely as a technical intermediary — we provide the interface and infrastructure, but the creative direction, prompts, input images, and all decisions about the generated content are made entirely by you, the user.

getVibeMotion exercises no editorial control over the content of any video, image, or animation generated through the platform. The visual content, subject matter, style, and any resemblance to real persons, places, or events that may appear in generated outputs are the result of user-provided inputs processed by third-party AI models — not decisions made by getVibeMotion. We bear no responsibility whatsoever for what appears in any generated video.

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account.

You may not share your account with others or use another person's account without permission. You must notify us immediately of any unauthorized use of your account.

• Tokens are required to generate videos and are consumed per generation request.
• Free accounts receive an initial token allocation upon registration.
• Paid plans include monthly token allocations as described on the pricing page.
• Unused tokens do not roll over between billing cycles.
• Tokens consumed by failed generations are automatically refunded.
• Tokens are non-transferable and have no monetary value outside the Service.

All payments are processed through Stripe. Subscriptions auto-renew unless cancelled before the next billing cycle. Refunds are handled in accordance with applicable consumer protection laws.

You may not use the Service to:

• Generate content that is illegal in your jurisdiction or the jurisdiction where it is distributed.
• Create non-consensual intimate imagery or deepfakes of real people without their explicit permission.
• Produce child sexual abuse material (CSAM) or any content that sexualizes minors — this will result in immediate and permanent account termination and reporting to law enforcement.
• Generate content intended to harass, threaten, or incite violence against any individual or group.
• Create fraudulent or deceptive content, including scams, misinformation, or impersonation of real persons or entities.
• Infringe on the intellectual property rights of others, including trademarks, copyrights, and rights of publicity.
• Circumvent any technical limitations, rate limits, or safety filters of the Service.
• Use the Service for any purpose that violates the acceptable use policies of the underlying AI model providers.

Violations may result in immediate account suspension or termination without refund, and we may report illegal activity to law enforcement authorities.

You retain ownership of the prompts and input materials you provide. Subject to the AI model providers' terms of use, you own the outputs generated from your inputs.

By publishing content on the public Experience feed, you grant getVibeMotion a non-exclusive, worldwide, royalty-free license to display, distribute, and promote that content within the Service. This license terminates when you unpublish or delete the content.

The getVibeMotion name, logo, and platform are the intellectual property of getVibeMotion. You may not use our branding without written permission.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

We do not warrant that the Service will be uninterrupted, error-free, or secure. We make no representations or warranties regarding the accuracy, quality, legality, safety, or appropriateness of any AI-generated content, including any videos, images, or animations produced through the Service. AI models may produce unexpected, inaccurate, offensive, or inappropriate outputs — including content that may unintentionally resemble real persons, copyrighted works, or trademarked material. You must review all generated content before using, sharing, or publishing it. getVibeMotion disclaims all responsibility for the content that appears in any generated video.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL GETVIBEMOTION, ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:

• Your use of or inability to use the Service.
• Any content generated through the Service.
• Any third-party claims related to content you generated, shared, or published.
• Unauthorized access to or alteration of your transmissions or data.
• Any other matter relating to the Service.

Our total aggregate liability for all claims arising from or related to the Service shall not exceed the amount you paid to us in the twelve (12) months preceding the claim.

We may suspend or terminate your account at any time, with or without notice, for conduct that we determine in our sole discretion violates these Terms, is harmful to other users or the Service, or for any other reason.

Upon termination, your right to use the Service ceases immediately. Provisions that by their nature should survive termination shall survive, including but not limited to: ownership provisions, warranty disclaimers, indemnity, and limitations of liability.

These Terms shall be governed by and construed in accordance with applicable law. Any disputes arising under or in connection with these Terms shall first be attempted to be resolved through good-faith negotiation between the parties.

If the dispute cannot be resolved through negotiation within 30 days, either party may pursue resolution through the competent courts.

We reserve the right to modify these Terms at any time. Material changes will be communicated via email or a prominent notice on the Service at least 14 days before they take effect.

Your continued use of the Service after the effective date of changes constitutes your acceptance of the updated Terms. If you do not agree to the modified Terms, you must stop using the Service.

You are solely and entirely responsible for all content you generate, upload, share, publish, or otherwise make available through the Service, including but not limited to: prompts, input images, generated videos, animations, manga pages, and any derivative works.

By using the Service, you acknowledge and agree that:

• You are the creator. The Service is a tool. You control the inputs (prompts, images, parameters) and you direct the outputs. As the person who initiates and directs the generation, you bear full legal responsibility for the resulting content — just as the operator of any tool is responsible for how they use it.
• No responsibility for video content. getVibeMotion does not control, influence, curate, or endorse what appears in any video, animation, or image generated through the platform. The visual content — including any depictions of persons, places, objects, text, brands, or events — is determined entirely by your inputs and the third-party AI model's processing. getVibeMotion assumes absolutely no responsibility for the content, meaning, or implications of any generated output.
• No liability for generated outputs. getVibeMotion shall not be held liable, directly or indirectly, for any content generated by users of the platform. This includes, without limitation, any claims related to defamation, libel, intellectual property infringement, right of publicity or privacy violations, obscenity, emotional distress, personal injury, or any other legal theory — whether in contract, tort, strict liability, or otherwise.
• AI outputs are unpredictable. AI models may produce unexpected, unintended, or inaccurate visual content, including content that may resemble real persons, copyrighted material, or trademarked imagery. You acknowledge this inherent unpredictability and accept sole responsibility for reviewing and evaluating all generated content before using, sharing, or publishing it.
• Compliance with laws. You are solely responsible for ensuring that your generated content complies with all applicable local, national, and international laws and regulations, including intellectual property laws, privacy laws, defamation laws, and content regulations in every jurisdiction where the content may be viewed or distributed.
• Third-party claims. You agree to indemnify, defend, and hold harmless getVibeMotion, its officers, directors, employees, and agents from and against any and all claims, damages, losses, liabilities, costs, and expenses (including reasonable attorney's fees) arising from or related to your use of the Service or any content you generate, regardless of whether such content was intentional or the result of unexpected AI model behavior.
• No review obligation. getVibeMotion has no obligation to pre-screen, monitor, or review user-generated content. However, we reserve the right to remove any content at our sole discretion.

You agree to indemnify, defend, and hold harmless getVibeMotion and its officers, directors, employees, contractors, and agents from any and all claims, liabilities, damages, losses, and expenses (including reasonable legal fees and costs) arising out of or in any way connected with:

• Your access to or use of the Service.
• Any content you generate, upload, share, or publish through the Service.
• Your violation of these Terms.
• Your violation of any applicable law or regulation.
• Your violation of any third party's rights, including intellectual property, privacy, or publicity rights.
